ClimateResponse® Residential and Small Business Participants
(Sensi ART Program Customers)

EFFECTIVE DECEMBER 1, 2025

Copeland has partnered with Olivine’s ClimateResponse® program. Participants with Sensi controllable assets will be provided the opportunity to earn incentives for the capacity of the entire utility service account associated with their Sensi equipment through enrollment in ClimateResponse®. In order to do so, they must accept the following terms and conditions:

  1. ELIGIBILITY: California residential or small business utility customers who are not enrolled in other utility or third-party Demand Response (DR) programs are eligible to participate in ClimateResponse®. Residential and Small Business utility customers are defined as utility account holders for buildings where the maximum monthly electric loads are less than 20 kW. Customers enrolled in any non-Olivine programs must disenroll prior to enrolling in ClimateResponse®. Limit one enrollment per service account.
  2. TECHNOLOGY: To be eligible for this program, participants must have an eligible Sensi thermostat installed at their premises. Although participants are able to participate behaviorally by responding to a ClimateResponse® Event and taking actions to reduce energy use during ClimateResponse® Events, participants must also have their Sensi thermostats controlled by ClimateResponse®.
  3. SMART METER: The service account being enrolled in ClimateResponse® must be serviced by a utility-approved smart meter that monitors energy usage at 15-minute intervals. (Note: most households in California have such smart meters)
  4. COMMITMENT: Participation in events is voluntary. During a ClimateResponse® Event the participant will be asked to reduce their energy usage as much as possible, and ClimateResponse® will control the participant’s Sensi thermostat to assist with the energy reduction, but the participant will not be penalized if they are unable to reduce energy usage.
  5. ENROLLMENT: Residential and small business utility customers can enroll through https://app.olivineinc.com/i/oepr/CREnrollRes?mod=em. Enrollment in ClimateResponse® requires participants to agree to the terms and conditions, as well as the ClimateResponse® Participation Agreement. Enrollment in this program is not complete until confirmed by Olivine.
  6. DAILY SCHEDULE: Due to requirements imposed on PG&E ART participants on TOU rates, for the first twelve months of enrollment, a participant on a TOU rate may not vary ClimateResponse®’s daily load shifting strategy. After twelve months of participation in ART, the customer has the option to opt out of the daily load shifting strategy. Regardless of daily load shifting, all customers will be included in ClimateResponse® events.
  7. EVENTS: Participating customers enrolled in ClimateResponse® will receive event notifications prior to an event from ClimateResponse® and may receive additional communications if appropriate from ClimateResponse®.
  8. EVENT TRIGGERS: ClimateResponse® Events will be triggered at the discretion of Olivine for one or more of the following reasons:
    1. PG&E distribution system emergencies or near-emergencies
    2. CAISO Energy Emergency Alerts and Flex Alerts between May 1st and October 31st
    3. High local greenhouse gas (GHG) emissions
    4. High wholesale energy prices
    5. Market awards
    6. Extreme weather
    7. Poor local air quality
    8. Event testing
  9. EVENT INFORMATION: 
    1. ClimateResponse® Events are called for a maximum of 4 hours.
    2. Minimum of 1 ClimateResponse® Event per month.
    3. Maximum of 2 ClimateResponse® Event per day.
  10. PARTICIPATION INCENTIVES: Participants will receive a $25 incentive for enrolling in the program and an additional $25 incentive after each year (12 months) of participation, provided they reduce their average energy usage by at least 0.5 kW during ClimateResponse® Events.
    1. NOTE: The reduction in consumption during a ClimateResponse® Event is measured relative to how much energy the customer typically used on other days preceding the event day during hours similar to the event hours as calculated from the utility service account meter.   11. INSTALLATION COSTS: If the Participant is installing equipment to participate in the program, the Participant is solely responsible for the cost of purchasing and installing the equipment. Olivine will not pay for installation costs or for any upgrades to the Participant’s electrical system. The Participant is responsible for hiring a qualified professional to estimate the cost of installation, obtain any necessary permits and install the equipment, and obtain any federal, state, or local incentives.
  12. PARTICIPATION COSTS: Enrollment and participation in the ClimateResponse® Program is free of charge.
  13. PROGRAM WITHDRAWAL: Customers may withdraw from the ClimateResponse® Program at any time without penalty by emailing ask@climateresponse.com.
  14. UPDATE OF TERMS AND CONDITIONS: These Terms and Conditions may be modified or updated by Olivine ClimateResponse® at any time upon notice to participants, which may be via email, app, or otherwise. The participant’s continued enrollment in the ClimateResponse® Program signals the participant’s agreement to any modified or updated Terms and Conditions.   15. PG&E TERMS AND CONDITIONS: This Program is provided by Olivine ClimateResponse® as an Automated Response Technology (“ART”) provider (“Provider”) under agreement with Pacific Gas & Electric Company (“PG&E”). Participant agrees to the following terms imposed by PG&E.

    1. Prohibited Resource Policy. Participant agrees to adhere to the CPUC Prohibited Resource Policy which does not allow the use of distributed generation technologies using diesel, natural gas, gasoline, propane, or liquefied petroleum gas, in topping cycle Combined Heat and Power (“CHP”) or non-CHP configuration during demand response (“DR”) events. Customer compliance and participation may be subject to verification performed by a Verification Administrator (which may be either PG&E or a third party). Non compliance with this policy will result in termination of Program participation.

    2. Surveys. Participant agrees PG&E may contact Participants to participate and complete surveys requested to measure customer satisfaction and inform Program improvements.

    3. Release of Participant’s Customer Data. Participant consents PG&E may receive, use, process, store, and copy Participant’s personal identifiable information, energy usage data, premise location, interval data, utility account number, billing data, documentation, other materials, (collectively referred to as “Customer Data”) obtained from their Program participation to enable PG&E to perform its administrative regulatory requirements, including but not limited to, provision of the Customer Data to the automated service provider (“ASP”) and other third party that is responsible for the Participant’s participation in the Program. Privacy is a priority for PG&E and every reasonable effort will be made to protect your Customer Data; see PG&Es Privacy Policy at http://www.pge.com/privacy.

    4. Participant Consent to Provide Customer Data to its CCA Energy Supplier. For Participants that receive their energy supply from a CCA, each such Participant agrees PG&E may disclose certain Customer Data to the Participant’s CCA in connection with such Participant’s participation in the Program.

    5. CPUC Rights. The CPUC may require this Program be modified or terminated at any time and all Customer Data will be made available upon their request. PG&E shall not be liable for any Customer Data disclosure by the CPUC.

    6. No Warranty and Disclaimer. NO WARRANTY AND DISCLAIMER BY PG&E. PG&E MAKES NO WARRANTY OR REPRESENTATION AND ASSUMES NO LIABILITY WITH RESPECT TO PROGRAM DESIGN, QUALITY, SAFETY PERFORMANCE, OPERATIONAL CAPABILITY, OR RELIABILITY AND EXPRESSLY DISCLAIMS ANY SUCH REPRESENTATION WARRANTY OR LIABILITY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSES.

    7. PG&E Limitation of Liability. Provider may be in control of coordinating the Participant’s participation in this Program. Provider is not PG&E’s agent or acting on behalf of PG&E for any purpose under this Agreement. PG&E shall have no liability whatsoever for any damages or claims resulting from any acts, omissions, or representations made by Provider in connection with the Provider’s Program solicitation or performance any of any Provider function and obligations under the Program. PG&E has no control of any of Participant’s technology, equipment, does not provide the Participant with any signal, or scheduling of any DR events and to address any such issues Participant must contact Provider.
